Acceptance of Terms

Thousand Oaks Sunrooms & Patios is a sunroom and patio contractor serving homeowners in Thousand Oaks, CA and surrounding communities. Our services include, but are not limited to, sunroom additions, patio enclosures, four-season rooms, screen room installation, patio cover installation, and related residential construction work. All services are subject to a separate written service agreement or proposal signed by both parties before work begins.

Estimates and Pricing

Any estimate or quote provided - whether by phone, email, or in person - is an approximation based on the information available at the time and is not a binding contract. Final pricing is confirmed only in a written proposal or service agreement. Pricing may change if:

• The scope of work changes after the estimate is provided
• Site conditions differ materially from what was described
• Permit or inspection requirements require additional work
• Material costs change between the estimate date and the start of work

We will notify you in writing before proceeding with any work that would change the agreed-upon price.

Scheduling and Cancellation

Scheduling is subject to availability and permit timelines. We will provide you with a project start date once permits are approved and materials are confirmed. Regarding cancellations:

• You may cancel a signed service agreement by providing written notice before work begins. Any deposit paid may be non-refundable if materials have been ordered or permit fees have been paid on your behalf.
• We reserve the right to reschedule due to weather, permit delays, material availability, or other circumstances outside our control.
• If you request a significant scope change after work begins, we may need to pause work and issue a revised service agreement before continuing.

Payment Terms

Payment terms are specified in your written service agreement. General terms:

• A deposit is typically required to secure your project start date and cover initial materials.
• Progress payments may be required at defined milestones during the project.
• Final payment is due upon completion of work and your acceptance of the finished project.
• Overdue balances may be subject to late fees as specified in your service agreement. We reserve the right to suspend work on projects with overdue balances.

Accepted payment methods will be specified in your service agreement. We do not accept payment in cash only unless otherwise agreed in writing.

Permits and Homeowner Responsibilities

For permitted projects, we will prepare and submit the required permit applications on your behalf. However, you are responsible for:

• Providing accurate property information, including HOA rules, easements, and deed restrictions
• Notifying us of any known underground utilities, septic systems, or other site conditions
• Obtaining any separate HOA approvals required by your association before construction begins, unless otherwise agreed in writing
• Ensuring access to the work area during scheduled work hours

Warranty Disclaimers

Any workmanship warranty applicable to your project will be specified in your written service agreement. General terms:

• Warranties cover defects in workmanship for the period stated in your agreement. They do not cover damage from misuse, accidents, acts of nature, or modifications made by others after completion.
• Manufacturer warranties on materials (glass, windows, roofing) are passed through to you and are subject to each manufacturer's terms and conditions.
• The Site and any information on it are provided "as is" without warranty of any kind. We do not warrant that the Site will be error-free or uninterrupted.

Limitation of Liability

To the maximum extent permitted by law, Thousand Oaks Sunrooms & Patios is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or from any services we provide. Our total liability for any claim arising out of or relating to a service agreement is limited to the amount you paid us under that agreement. Some jurisdictions do not allow certain limitations of liability, so these limits may not apply to you.

Dispute Resolution

If you have a concern or complaint about our services, please contact us first. We will make a reasonable effort to resolve the issue informally.

If we cannot resolve a dispute informally, both parties agree to attempt mediation before pursuing any other legal remedy. Any unresolved disputes will be handled in accordance with the governing law section below.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms will be brought in the appropriate courts of California.
